Lehigh County Man Shot By Constables Serving Warrants

"I saw him saying he can't breath and he can't move," said Hafeezah Muhammad. She says she's the longtime girlfriend of 38-year old Kevin McCullers who investigators say was shot Thursday morning by State Constables. It happened as they were attempting to serve nearly two dozen warrants for multiple summary parking offenses.

"This is really heartbreaking to me," said Muhammad.

The Lehigh County District Attorney says around 7:30 Thursday morning the Constables were staking out McCullers home on Portland Drive in Whitehall Township when they heard the garage door open. One Constable approached McCullers who was in the car about why they were there. Investigators say at some point McCullers put the car in reverse and with the doors open allegedly began backing out with both Constables in the garage.

"One of the Constables fired a shot toward the victim Mr. McCullers. The other Constable at some point fired a shot into the left front tire of the gray Acura, the vehicle Mr. McCullers was operating at the time," said  Lehigh County District Attorney James Martin.
McCullers was shot once in the back. His girlfriend, whom he has a son with, claims she was told by doctors at Lehigh Valley Hospital that he's paralyzed.

"All for parking tickets. This is for parking tickets. He wasn't armed," said Muhammad.

District Attorney Martin says he's disturbed that there would be a shooting from attempting to serve parking tickets but says he's also sure this could have ended without incident if  McCullers had complied. 

"And simply done what they asked him to do which was to accompany them to the various Magisterial District Judges offices," said D.A. Martin who will decide if criminal charges will be filed against McCullers or the Constables. Their guns have been turned in for the investigation.
