Judge: Give up the dogs or leave Hazel Park

HAZEL PARK, Mich. (WJBK) -- On Wednesday, a judge ruled that a Hazel Park family must give their dogs away or move from the city of Hazel Park, after one of the family dogs attack a neighbor's dog.

Sasha, a 2-year-old Alaskan Malamute owned by the Gilbert family, was quarantined in a Pontiac shelter, after she bit a neighbor's smaller dog on May 18.

Sasha was the only dog involved in the incident, but Judge Charles Goedert ruled that all three family pets are banned from the city.

The family has decided to leave the city of Hazel Park, in order to keep their dogs.  The family and their pets must leave Hazel Park by July 31.

Earlier this week, FOX 2's Maurielle Lue spoke with the family, who made a tearful plea to the city to keep Sasha from being put down.

"The order says that we have to go to court to prove reason why our dog should not be put down or listed as a dangerous dog. She belongs to my autistic son, so this has been very hard for him to be without her, and right now Sasha Bear is currently pregnant with a litter of puppies and she's due a week after the court date," says Rachelle Gilbert.

"She helps me when i'm upset and angry. She is, she means the world to me. I would give my life for that dog," said 12-year-old Nathan Gilbert, "I have had real trouble sleeping at night without her and I just miss her because every day I wake up and her bed is in the the kitchen. Every day I wake up and I see that empty space and it makes me sadder every day."

The dog that sasha bit needed 10 stitches and a draining tube after the attack. The vet bill was upwards of $700, money the Gilbert family says they agreed to pay but Sweetie's owner tells a different story.

"Since we've been subpoenaed to go [to court], she's been calling me asking how the dog is and wants to make arrangements for payment, but nothing before then," says June Dockery.

Dockery says she only wanted to see the dog muzzled and the Giberts' fence reinforced so Sasha couldn't get out. Dockery says it was a city attorney who pursued the case, even though Sasha doesn't have a history of violence.

Lue spoke with a Hazel Park city attorney off-camera Monday and reports that the attorney said Sasha's owners are irresponsible for failing to initiate payment, and even though it was Sasha's first offense, the case should be treated like a first offense for assault or even attempted murder.
