Mother of man killed in fight with Fmr. Mayor Daley's relative sues

CHICAGO (Associated Press) -

The mother of a man killed in a 2004 altercation with the nephew of former Chicago Mayor Richard M. Daley filed a federal lawsuit Monday against the city's police department and several officials for violating her son's civil rights.

Nanci Koschman accuses police of "hiding facts and creating phony evidence to cover up the truth" about David Koschman's death. Attorney Locke Bowman said Nanci Koschman woman was "misled, deceived, dissuaded and literally abused."

David Koschman, 21, of Mount Prospect died days after he fell and struck his head during a fight with Richard J. Vanecko outside a bar in Chicago's Gold Coast neighborhood. Vanecko, 39, of Costa Mesa, Calif. pleaded guilty in January to involuntary manslaughter and is serving a 60-day jail sentence.

The lawsuit also names former Police Superintendent Phil Cline, Cook County State's Attorney Anita Alvarez, former State's Attorney Richard Devine, former Superintendent Jody Weis, more than 20 current and former detectives and unnamed Daley "family members or associates." None of those named in the lawsuit commented Monday.

The case has generated widespread attention and has raised questions about whether Chicago police and Cook County prosecutors mishandled the original case.

Koschman's family contended there was a police cover-up. But a special prosecutor released a report in February that concluded there's no evidence Daley or other family members sought to influence an investigation into Koschman's death.

Nanci Koschman said she is suing because she is hoping to find answers about why Vanecko wasn't charged sooner.

"If I get the answers, it will make me more at peace," she said.
