No charges after DPD officer's gun goes off, kills young woman

The Wayne County Prosecutor's Office has decided not to charge the officer whose gun somehow went off during a party at his house in July of 2012. The gunfire killed 24-year-old Adaisha Miller. A spokesperson for the prosecutor's office says not enough evidence exists to charge the officer. The family's attorney disagrees.

"You don't have a loaded gun without a safety concealed in your pants at a party where people are drinking, where people are partying, where people are dancing," says Gerald Thurswell, the family's attorney.

"He was negligent. He was negligent with his weapon. He's responsible for it," says Yolanda McNair, Adaisha's mother.

FOX 2's Robin Schwartz has learned the family did reach a confidential settlement with Officer Parrish through his homeowner's insurance. The amount of money involved was not disclosed.

But that doesn't take away the family's pain. Officer Parrish is still on the job and with the police force while the family is left with memories and lingering questions.

Adaisha's mother says she'll keep pressing for answers even if the prosecutor won't. The family had to file a Freedom of Information lawsuit just to get documents in the case.

"You stonewalled us. You lied. Your refuse to give us our information. You refuse to give us the evidence that we asked for. So you're hiding something," says Adaisha's mother.

Adaisha would have turned 27 this year. Her family says they plan to continue celebrating her life and pursuing justice for her untimely death.
