Suit: Men accuse Harvey police of excessive force

Two men found not guilty of possessing drugs and weapons claim they were the subjects of excessive force and are suing the city of Harvey, two police officers and three detectives.

Lawrinth Wicks and Gregory Taylor filed the three-count lawsuit in federal court Thursday, alleging Harvey police violated the Civil Rights Act and denied them their constitutional rights.

On Jan. 21, 2012, Wicks and Taylor were sleeping in a home in the 15200 block of Marshfield Avenue in Harvey when police executed a search warrant, according to the lawsuit. Neither man lived at the home.

Wicks and Taylor were handcuffed while officers searched the residents, the lawsuit claims.

After the search was complete, officers threw Wicks to the ground and beat him in the torso and head, causing him to suffer an injury to his neck and back, the suit alleges.

Taylor claims in the lawsuit officers threw him up against the wall and punched him in the face.

Both men were unarmed, they claim.

Wicks and Taylor were both charged with three counts of aggravated unlawful use of a weapon by a felon, one count of defacing identification marks of a firearm and one count of possession of a controlled substance, according to the lawsuit.

On April 3, 2013, a Cook County Circuit Court judge found both men not guilty of all charges after a bench trial, the lawsuit claims.

The three-count lawsuit claims excessive force and false arrest, among other things, and seeks to hold the city responsible.

A representative from the city of Harvey could not be immediately reached for comment Thursday night.

Wicks and Taylor are seeking an unspecified amount in damages.
