Homeless convict gets life sentence for sexual assault in Grant Park

A homeless convict will serve the rest of his life in prison for beating and sodomizing a 65-year-old man with a tree branch in 2011, the Cook County state's attorney's office announced Thursday.

Cortez Foster, 47, was sentenced Thursday by Judge Dennis Foster to natural life plus seven years in prison, according to the statement. He was previously convicted of aggravated criminal sexual assault and robbery in connection with the sexual attack and robbery of the northwest suburban man in Grant Park in 2011.

According to prosecutors, the Schiller Park man was walking through Grant Park around midnight when Foster approached and began punching and kicking him, before removing his pants and using a tree branch to sexually assault him. Foster then stole the man's cell phone and fled.

The victim, wearing only a sock and shirt, was spotted propping himself up on a concrete railing at Michigan and Balbo, police said at the time. Someone called 911 to report an undressed man with a bloodied face.

The man couldn't speak and was bleeding from his head, mouth and nose, authorities said. He had to be fingerprinted in order for detectives to identify him.

The victim suffered severe head trauma, eye and nose fractures, and brain swelling, authorities said at the time. Doctors had to remove the tree branch, 7 inches long and 1/2 inch in diameter, from the victim's rectum.

"He was beaten up real bad," a police source said. "It was an act of extreme violence."

Investigators were able to track Foster down at the homeless shelter after they tracked the victim's cell phone to an apartment complex, where a witness told police he had bought the phone from Foster in exchange for three Viagra pills, prosecutors said.

Foster admitted the blood on his clothes was from the victim, admitted to the vicious attack and said he "used" the tree branch.

At the time of the attack, Foster was on parole after being released from prison for a 2000 armed robbery conviction. He also has a convictions for aggravated criminal sexual assault and armed robbery in 1991, and robbery in 1996.
