NEW YORK (AP) - A performance artist has won her suit against the NYPD for arresting her for baring her breasts in public.

The New York Post  reports that Holly Van Voast settled the suit for $40,000.

The 46-year-old artist goes topless while sporting a penciled in moustache and Marilyn Monroe hairdo.

She claimed she was illegally arrested at least 10 times for going topless in public "while exercising her right to be topless anywhere a man is permitted to be topless."

She says she didn't expose herself. Instead, she says "I exposed everybody else."

According to court papers, the city has also agreed to pay Van Voast's legal fees.

Going topless in public is not illegal in New York State.
