Starbucks fights Starbarks Dog Daycare to change name

A local business is in trouble with Starbucks.

Since Andrea Mccarthy Grzybek and her husband opened Starbarks Dog Daycare and Boarding seven months ago, she's had an average of seven furry four-legged customers a day. It's a small business in Algonquin with an eye catching green and white logo.

Many people love the name, but one coffee giant doesn't.

Starbucks sent Starbarks Dog Daycare a cease and desist letter in April stating that their logo is an unauthorized use of the corporations intellectual property and that the similiarities is "likely to cause confusion among customers" who may mistakenly believe the two are affiliated. Most patrons say they would never mix up the two businesses.

"We offered to change the green to yellow and the stars to black paws," Grzybek explains.

But that wasn't enough for Starbucks. Besides the logo, they've also asked the dog daycare to get rid of its name and website, Starbucks spokesman Zack Hutson told FOX Chicago News "We have a legal obligation to protect our trademark in order to maintain our exclusive rights to it."

"[Starbucks] is concerned that if they allow third parties to use similiar marks, that eventually more and more will start to use it, and eventually dilute the strength of their mark," says Scott Slavick, a Chicago trademark attorney.

"It might be a tactic from a big corporation to push the little guy around..but, it works," Andrea said.

The last thing the owners want is a legal battle in court. In fact, they say they can't even afford to hire an attorney. So, in the meantime, they say they're looking for another name for the business to replace Starbarks.
