DETROIT (WJBK) -

There has been a delay in deliberations in the bid-rigging trial of Bobby Ferguson.  The judge moved in an alternate juror after one juror on the panel got sick.

The defense attorneys in the case did not want another juror brought in.  The jurors had deliberated for nearly two days.  They had already asked questions, and the defense attorneys thought collectively that things may be going their way and didn't want that upset.

The irony about this is that the alternate juror is an African-American.  When this trial first started, it was the defense that said they wanted more African-Americans on the jury.  Here's their chance to get another African-American on the jury and yet they didn't want it.

Meanwhile, the U.S. Attorney's Office said they wanted twelve jurors, which is standard.

The judge ultimately decided there would indeed be twelve jurors, the alternate juror was seated and deliberations started all over from scratch.

After about three hours, the judge dismissed the jury.  He ordered them to return at 8:00 a.m. Wednesday.
