Cook County states attorney contends gay marriage ban is unconstitutional

Cook County State's Attorney Anita Alvarez contends Illinois' gay marriage ban is unconstitutional and is filing a motion supporting a lawsuit opposing the law.

Alvarez said Thursday she agrees with the plaintiffs' assertion Illinois' Constitution upholds marriage equality for same sex couples just as it does for opposite sex couples

Cook County Clerk David Orr says he has filed a response in which he agrees with the lawsuits filed against his office.

The lawsuits by the American Civil Liberties Union and New York-based Lambda Legal represent 25 Illinois couples. It was filed a year after Illinois legalized civil unions. However the lawsuit's plaintiffs say civil unions made them feel like second-class citizens.

Thomas More Society executive director Peter Breen says he is disappointed Alvarez won't defend the gay marriage ban.
