Chicago - A federal judge today gave the OK for Chicago Public Students to transfer from Fenger High School if they feel unsafe following the beating death of student Derrion Albert .
Ten students filed a lawsuit last week against CPS saying their right to education was being denied because they weren't allowed to transfer, according to the Chicago Tribune.
"That's a measurable offer you shouldn't pass up," said U.S. District Judge Robert Gettleman said. "It's a little early to settle a case challenged on behalf of the defense."
